1. Acceptance of Terms

By accessing and using Prompt Kitchen, a service provided by Montgo Labs S.L., you accept and agree to be bound by the terms and provision of this agreement. In addition, when using these particular services, you shall be subject to any posted guidelines or rules applicable to such services.

2. Description of Service

Prompt Kitchen provides a platform to manage, organize, and optimize AI prompts. We reserve the right to modify, suspend or discontinue the Service with or without notice at any time and without any liability to you.

3. User Accounts

  • You must provide a valid email address to complete the signup process.
  • You are responsible for maintaining the security of your account and password. We cannot and will not be liable for any loss or damage from your failure to comply with this security obligation.
  • You are responsible for all content posted and activity that occurs under your account.

4. Acceptable Use

You agree not to use the Service to:

  • Upload or transmit any content that is unlawful, threatening, abusive, defamatory, or invasive of another's privacy.
  • Attempt to circumvent any restrictions or acceptable use policies of third-party APIs (e.g., OpenAI) tied to Prompt Kitchen's optimization features.
  • Interfere with or disrupt the Service or servers connected to the Service.
  • Exploit, sell, or reproduce any portion of the Service without express written permission from Montgo Labs S.L.

5. Payment and Subscriptions

If you upgrade to a paid subscription:

  • You will be billed in advance on a recurring, periodic basis (e.g., monthly or annually).
  • Payments are processed securely via our third-party payment providers (e.g., PayPal, Stripe).
  • You may cancel your subscription at any time. Cancellation will take effect at the end of the current paid term.
  • Refunds are processed on a case-by-case basis and at the sole discretion of Montgo Labs S.L., in accordance with applicable consumer protection laws.

6. Intellectual Property

You retain all rights and ownership to the prompts and data you input into Prompt Kitchen. The look and feel of the Service, including the codebase, design, and UI/UX, is copyright © 2026 Montgo Labs S.L. All rights reserved.

7. Disclaimer of Warranties

The service is provided on an "as is" and "as available" basis. We expressly disclaim all warranties of any kind, whether express or implied, including, but not limited to the implied warranties of merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the results obtained from the use of the AI optimization features will be accurate or reliable.

8. Limitation of Liability

Montgo Labs S.L. shall not be liable for any direct, indirect, incidental, special, consequential or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data or other intangible losses resulting from the use or the inability to use the service.

9. Governing Law

These Terms shall be governed and construed in accordance with the laws of Spain, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
